  36.   CONDITIONS, REPRESENTATIONS, AND WARRANTIES, INCLUDING ANY IMPLIED
  37.   WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A
  38.   PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ARE DISCLAIMED, EXCEPT TO THE
  39.   EXTENT THAT SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.

  46.   AGREEMENT, WHETHER FOR BREACH OR IN TORT, WILL BE LIMITED TO THE FEES
  47.   PAID BY LICENSEE FOR SOFTWARE WHICH IS THE SUBJECT MATTER OF THE CLAIMS.
  48.   IN NO EVENT WILL GREATPROGS BE LIABLE FOR ANY INDIRECT, PUNITIVE,
  49.   SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGE IN CONNECTION WITH OR ARISING
  50.   OUT OF THIS AGREEMENT (INCLUDING LOSS OF BUSINESS, REVENUE, PROFITS, USE,
  51.   DATA OR OTHER ECONOMIC ADVANTAGE), HOWEVER IT ARISES, WHETHER FOR BREACH
  52.   OR IN TORT, EVEN IF GREATPROGS HAS BEEN PREVIOUSLY ADVISED OF THE
  53.   POSSIBILITY OF SUCH DAMAGE. LIABILITY FOR DAMAGES WILL BE LIMITED AND
  54.   EXCLUDED, EVEN IF ANY EXCLUSIVE REMEDY PROVIDED FOR IN THIS AGREEMENT
  55.   FAILS OF ITS ESSENTIAL PURPOSE.
